TERMS OF SERVICE

Clear rules for a profile that speaks on your behalf.

These terms govern Ask The Talent’s early-access account, document-processing, publishing, and public conversational-profile service.

Effective: 2026-09-02 · Version 1.0

1. Provider

The service is provided by Ask The Talent Preview, Temporary preview configuration pending. Contact: preview@askthetalent.com.

2. Eligibility and agreement

You must be at least 18 and legally able to enter an agreement. By creating an account, you accept these terms and the Privacy Policy. If you use the service for an organization, you confirm that you may bind it. Paid plans, if introduced, require separate pricing and checkout terms before any charge is made.

3. Your account

Provide accurate information, protect your credentials, and notify support of suspected compromise. You are responsible for activity under your account unless caused by the provider. Accounts are personal and may not be sold or transferred without written approval.

4. Your content and permissions

You retain rights in CVs, documents, answers, and profile content you submit. You grant the provider a limited, non-exclusive permission to host, parse, transform, retrieve, display, and transmit that content only as needed to operate, secure, and improve the contracted service. You confirm that you have the necessary rights and must avoid uploading unnecessary third-party personal data, confidential material, malware, or unlawful content.

5. Public profiles and privacy choices

You decide whether to publish and which supported categories are public. A public link can be visited and shared by anyone who receives it. Do not publish information you would not want publicly accessible. Privacy controls reduce disclosure by the agent but cannot prevent a visitor from copying information already made public.

6. AI limitations

AI responses can be incomplete, inaccurate, or misunderstood. Profile owners must review extracted facts, answers, and sharing settings. Visitors must independently verify important hiring, legal, financial, safety, or identity decisions and must not treat the agent as the owner’s binding statement, reference, or guarantee.

7. Acceptable use

You may not use the service to impersonate another person; publish content without rights; discriminate unlawfully; harass, deceive, or defame; distribute malware; probe or bypass security or privacy controls; scrape at abusive scale; reverse engineer protected components except where law permits; or use outputs to make solely automated decisions with legal or similarly significant effects without a lawful process and meaningful human review.

8. Service operation

The service may change, experience maintenance, or be temporarily unavailable. Reasonable notice will be given for material adverse changes where practicable. Early-access features may change before general availability. The provider may suspend access when reasonably necessary to protect users, investigate abuse, comply with law, or prevent material harm.

9. Termination and deletion

You may end the agreement at any time by permanently deleting your account. The provider may terminate for a material breach after reasonable notice and an opportunity to cure where appropriate, or immediately for serious security, legal, or abuse risk. Deletion and residual backup handling follow the Privacy Policy.

10. Intellectual property and feedback

The service software, branding, and interface remain the provider’s or licensors’ property. No ownership is transferred. If you voluntarily provide feedback, the provider may use it without restriction or payment, provided the use does not publicly identify you without permission.

11. Responsibility and liability

Nothing excludes liability that cannot legally be excluded, including liability for intent, gross negligence, injury to life, body or health, fraudulent concealment, guarantees, or mandatory product liability. For slight negligence, liability is limited—where legally permitted—to breach of essential contractual duties and foreseeable, typical damage. Mandatory consumer rights remain unaffected.

12. Governing law and disputes

German law applies, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods, while mandatory protections of a consumer’s habitual residence remain unaffected. Statutory venues and consumer remedies remain available. The operator must add the legally required consumer-dispute-participation statement before offering the service to consumers.

13. Changes and contact

Material changes will be announced with reasonable notice unless urgent security or legal reasons require faster action. Continued use after the effective date constitutes acceptance where legally permitted; otherwise fresh agreement will be requested. Questions: preview@askthetalent.com.
